Martinez Says Son Seeks Testimony in Custody Battle
Olivier Martinez filed court documents saying his and Halle Berry's 13-year-old son, Maceo, wants to testify about an alleged September 26 altercation and his custody preferences. On October 1, Martinez sought sole custody and a temporary domestic violence restraining order for himself and Maceo after alleging Maceo said in a phone call that Berry physically attacked and choked him. The pair had a 50-50 custody agreement and finalized their divorce in 2023 after an eight-year legal battle. Martinez wrote that Maceo should have the opportunity to have his voice heard regarding what he experienced that night, and that he fears blocking testimony is an attempt to escape culpability. He claimed Maceo has told therapists his mother was physical with him and that they dismissed those concerns. Berry filed an October 5 declaration stating she has never physically, emotionally, or otherwise abused Maceo, is a victim of domestic violence who helps victims, is not a perpetrator of violence, and would never hurt their child. Attorney Marina Beck said calling the filing entirely meritless and deliberately misleading would be an understatement. Berry's 18-year-old daughter Nahla Aubry filed an October 3 declaration defending her mother; Martinez asked that Nahla be excluded, arguing she is biased. A hearing is set for October 16.
